In his ruling, Justice John Omotoso made reference to Section 7 (6) of the Police Act 2020, which put the tenure of office of any Inspector General of Police at four years.

The Federal High Court in Abuja on Tuesday dismissed a suit seeking to sack the Inspector General of Police (IGP), Alkali Baba Usman.

The suit was instituted by an Abuja-based activist Michael Sam Idoko.

In his ruling, Justice John Omotoso made reference to Section 7 (6) of the Police Act 2020, which put the tenure of office of any Inspector General of Police at four years.

According to him, the IGP’s retirement from the Nigeria Police Force has nothing to do with his appointment because his four years tenure is sacrosanct.

Justice Omotoso noted that besides the plaintiff who claimed to be a social crusader, he had no jurisdiction in instituting the case under the guise of public interest.

He held that the plaintiff failed to establish having any peculiar or special interest over and above other Nigerians.

The judge advanced that the plaintiff was a busybody and meddlesome interloper, noting that he was neither a serving police officer qualified for appointment nor ever applied for IGP’s position and was denied, hence he has no legal law in filing the suit.

Justice Omotoso subsequently dismissed the suit without any cost to the plaintiff.

It would be recalled that Idoko, through his Counsel, Chief James Ogwu Onoja (SAN) had in a suit marked FHC/ CS/ 31/2023 dragged the IGP, President Muhammadu Buhari and four others to court over the legality of the continuous stay of the IGP in the office has reached the retirement age.
