Adamawa State Drags FG to Supreme Court over Alleged FAAC Deductions | #Politicsnigeria
The Adamawa State government has filed a lawsuit against the federal government at the Supreme Court, challenging alleged unconstitutional deductions from the Federation Account.
The state seeks a definitive interpretation of Section 162 (1), (2), and (3) of the constitution, which governs revenue distribution among all tiers of government.
According to a statement released by Humwashi Wonosikou, the Chief Press Secretary to Governor Ahmadu Fintiri, on Wednesday evening, the state government insists that the entire sum in the Federation Account must be distributed without deductions, except as permitted by law.
The government emphasizes that the president must strictly comply with the Constitution in managing and distributing revenue.
The Adamawa State government argues that all revenue collected, except those exempted by the constitution, must be paid into the Federation Account for distribution to all tiers of government.
The state seeks a declaration from the Supreme Court that any deductions or withholdings made without constitutional backing be declared unconstitutional.
The government stresses that the federal government’s discretion to manage revenue is limited to only what is expressly permitted by the Constitution. Adamawa State seeks a strict interpretation of the constitution to ensure that revenue distribution is conducted without arbitrary deductions or withholdings by the federal government.
