A lawyer identified as Nupe has shared some tips to married couples on avoiding sharing properties with their ex-partners after divorce.
According to the lawyer, if anyone marries under the Act, either at the Marriage Registry or License Church, any property made during the marriage that comes in the name of just couple will be shared after a divorce.
He added that the court does not consider the fact that the other party didn’t contribute financially to the property but it would be shared fairly and equitably.
While sharing how one can avoid sharing properties with their ex-partners, he advised that they have a prenuptial agreement. This is an agreement made by a couple before they marry concerning the ownership of their respective assets should the marriage fail.
Secondly, he suggested that couples should marry under customary law and Islamic law only.
He lastly added that the acquired properties should be in the name of another company and a revocable living trust must be created to avoid sharing properties with ex-partners.
